Booking Conditions

Reservations, Deposits and Final Payments

Early reservations are recommended. Each participant must complete a separate signed reservation form and send it with a 15% deposit per person. All payments made to The Heritage Safari Company ( hereinafter referred to as the “Company” throughout this document) are held in a trust account. Upon receiving your deposit we will send you a confirmation letter, detailed trip itinerary and general information needed to prepare for your trip.

Final payment is due 60 days prior to departure. If reservations are made less than 60 days prior to departure, full payment is required.

Cancellation by Customer

Cancellations are only effective on receipt of written notification. If a booking is cancelled prior to 90 days before departure, you forfeit your deposit. If the booking is cancelled less than 90 days before departure, The Company shall retain the full deposit and a cancellation fee will be payable by the client as follows:
89 – 45 days deposit plus 25% of total fare
44 – 25 days 70% of total fare
24 – 0 days 100% of total fare

Prices

The company’s prices are subject to change since they are based on known costs at time of publication. Between that time and the time of the trip’s actual departure, possibility of cost increases may occur in connection with: exchange rates, taxes, park fees, government action such as increases in VAT, that we cannot absorb.

Cancellation by the company

The Company reserves the right to cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or any reason whatsoever it is not viable for us to operate the planned itinerary. The refund of all land payments received shall release the Company from any further liability. The Company is not responsible for any incidental expenses that you may have incurred as a result of your booking such as visa fees, inoculations, non-refundable air tickets.

Alterations to Itineraries

All itineraries are suggested only.The Company reserve the right to make changes in the trip itineraries and any of the facilities discribed in all publications, leaflets or promotional documentations.

Travel Insurance

Travel insurance is compulsory for all The Heritage Safari Company Inc. participants with coverage for trip cancellation or curtailment, medical expenses arising from illness or accident before or during the trip , evacuation and repatriation in case of emergency ,death, any loss or theft of baggage, money or personal effects. Participants should ensure that there are no exclusion clauses limiting protection such as trekking, mountaineering activities. Participants must provide proof of travel insurance when confirming a booking with a deposit.

Risks

The Company draws your attention to the fact that there are certain inherent risks involved in participating in the type of trips sold by the company and that you must accept them at your own risk. It is your sole responsibility to take all appropriate medical advice prior to departure as to whether or not you are fit enough to undertake the trip booked. The Company shall not be liable for illness, injury or death sustained on a program sold by the Company which is not due to the gross negligence of the Company, its officers, employees, authorized representatives or agents whomsoever.

Travel Documents, Visas, Vaccinations

It is the responsibility of the participant to ensure that passport (valid for at least six month beyond your return date), visas, travel permits, health certificates, inoculations, or other documentation required for the trip are obtained and are in order before leaving North America. The company may not be held liable for any failure on the part of a client to be in possession of the correct travel documentation.

Responsibility

Neither the Company nor any person or agent acting for, through or on behalf of the Company shall be liable for any loss, damage, death, delay or inconvenience or additional expenses whatsoever caused to goods or persons by the breakdown, failure or cancellation of transport or communications, accomodations, strike, wars, threats of war, lock-outs, revolutions, dots, terrorist activity, controls and regulations of countries and governments, or acts amounting to an Act of God or force majeure.

The Company’s liability for change or cancellation for reasons beyond the company’s control will be limited to a full refund and no other compensation will be payable.

The Company does not accept liability for the acts or omissions of tour operators, hotels, carriers, or other outside the Company over which it has no control.

Good Health

All participants confirm that they are in good health. Anyone with pre-existing medical condition, suffering from illness or a disability must declare the true nature of such condition at the time of booking. The Heritage Safari Company Inc. reserves the right to exclude a participant from any tour if the Company considers the participant as unsuitable for the tour.

Jurisdiction

These conditions are subject to Canadian Law as applied in the Province of British Columbia and Courts in that Province shall have sole jurisdiction.
